Terms of service.

These Terms govern your access to and use of Fluxly, a realtime analytics service for website owners who want a clear view of live traffic without bloated analytics software.

By creating an account, installing the tracking script, or using Fluxly, you agree to these Terms.

You may use Fluxly only for websites, applications, or properties that you own or are authorized to manage.

You are responsible for your account, your sites, and your compliance with laws that apply to your use of analytics, cookies, local storage, privacy notices, and consent requirements.

You must provide accurate account information and keep your login credentials secure. You are responsible for activity under your account.

If you believe your account has been compromised, you should contact us promptly and rotate any exposed credentials or install scripts where appropriate.

Fluxly plans may include pageview limits, site limits, or other usage limits. The Free plan includes 1 site and 10,000 pageviews per month.

If a Free account reaches its monthly pageview limit, analytics collection may pause until the monthly reset or until the account upgrades.

We may add, remove, or change plan limits, features, or pricing. When changes materially affect active paid customers, we will make reasonable efforts to provide notice.

Paid subscriptions are billed through Stripe. By starting a paid subscription, you authorize recurring charges for the selected plan until canceled.

Subscription fees are generally non-refundable except where required by law or where Fluxly chooses to issue a credit or refund. You can manage billing through the Stripe billing portal when available.

If payment fails, we may retry payment, downgrade the account, pause analytics collection, or limit access until billing is resolved.

You may not use Fluxly to collect passwords, payment card data, health data, private form contents, or other sensitive personal information through analytics events.

You may not abuse the service, probe or attack systems, interfere with other users, bypass limits, reverse engineer private APIs, resell access without permission, or use Fluxly for unlawful activity.

You retain ownership of your websites and analytics data. You grant Fluxly the rights needed to process, store, transmit, display, and secure that data so we can provide the service.

Fluxly owns the service, software, interface, branding, and related technology. These Terms do not transfer ownership of Fluxly intellectual property to you.

Fluxly aims to provide a reliable service, but we do not guarantee uninterrupted availability, error-free operation, or that analytics will always be complete or perfectly accurate.

Analytics can be affected by browsers, blockers, network failures, bot filtering, privacy tools, script installation issues, rate limits, and other factors outside our control.

You may stop using Fluxly at any time. You may request account deletion through the available support or contact channels.

We may suspend or terminate access if you violate these Terms, create risk for the service, fail to pay, or use Fluxly in a way that may harm Fluxly, other customers, or third parties.

Fluxly is provided as is and as available, without warranties of any kind to the maximum extent permitted by law.

To the maximum extent permitted by law, Fluxly will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption.

To the maximum extent permitted by law, Fluxly's total liability for any claim will not exceed the amount you paid to Fluxly in the 3 months before the claim, or 100 USD if you used only a free plan.

You agree to defend and hold Fluxly harmless from claims arising from your websites, your use of Fluxly, your violation of these Terms, or your violation of applicable laws or third-party rights.

These Terms are governed by the laws of the United States and the state where Fluxly is operated, without regard to conflict-of-law rules.

Before either party starts a formal dispute, the parties agree to try to resolve the issue informally by contacting each other and allowing a reasonable period for response.

We may update these Terms as Fluxly changes. The updated version will be posted on this page with a new effective date. Continued use of Fluxly after changes means you accept the updated Terms.
